Point of Collection Notice

This Point of Collection Notice (“POCN”) is intended to inform visitors, users, and others of the website (“consumers” or “you”) of the categories of personal information Engle Martin & Associates, LLC (the “Company”) collects and what purpose the information is used by the Company as required by the California Consumer Privacy Act of 2018 (CCPA) and Illinois Data Transparency and Privacy Act (SB2330) . Those terms defined in the CCPA & SB2330 have the same meaning when used in this POCN.

Categories of Personal Information We Collect about California Consumers

  • Identifiers such as name, physical address, email address and other credentials used when you visit the website, use our applications or interact with Company related tools, widgets or plug-ins, internet protocol address unique device identifier.
  • The following categories of personal information described in the California Civil Code §1798.80(e): (1) the personal information listed in the preceding bullet point as “identifiers,” (2) signature, (3) telephone number, (4) payment information (including payment card details or online payment services number and invoicing address) and financial information (such as bank account numbers), (5) employment information for completion of job applications and related services, (6) medical information related to the employment application process, (7) driver’s license number, commercial driver’s license number and other information related to the employment application process, and (8) the other information that identifies, relates to, describes, or is capable of being associated with, a particular individual that we describe in the Privacy Policy.
  • Protected classification characteristics under California or federal law, including date of birth, gender and veteran or military status.
  • Commercial information, including (1) records of services purchased or received from Company, (2) information on or related to actions taken on the website or mobile applications, which may include information about services considered, and/or validation or authentication of same, and (3) information about consumer preferences and behavior that we collect on the website and mobile applications or purchase from third parties in order to target consumers for digital advertisements or to personalize content we deliver on the website and mobile applications.
  • Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with the website and mobile applications, and advertisements that are displayed or linked on the website or mobile applications or our advertisements that are displayed or linked on third-party sites and applications.
  • Geolocation data.
  • Audio information from calls placed with those for whom consent had been received, or from manual dialed campaigns, which may be recorded, and electronic information in the form of Internet or other electronic network activity information as described above.
  • Professional or employment-related information in the form of business contact information such as name, company name, physical address and email address and telephone or fax number, current or past employment history, prior performance information, and other information associated with applications for employment as a commercial driver.
  • Inferences drawn from (1) the information we collect when you visit the website, use our applications, or interact with Company-related tools, widgets or plug-ins or our official social media pages or Company-related social media applications, tools, widgets and plug-ins, (2) information we collect, including through third-party suppliers and vendors, regarding content and other data posted on the internet (such as public locations on the internet), and (3) information about consumer preferences and behavior that we collect on the website and mobile applications or purchase from third parties in order to create a profile about a consumer reflecting the consumer’s preferences, characteristics, predispositions, behavior, and attitudes.

Pursuant to the CCPA, personal information does not include the following:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from the CCPA’s scope such as:
  • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data.
  • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

Categories of Personal Information We Collect about Illinois Data Transparency and Privacy Act

  • Identifiers such as name, physical address, email address and other credentials used to when upon the adjuster discussion of the claimant.
  • The intake form hosted on the website, internet protocol address unique device identifier.
  • The following categories of personal information described in Illinois Civil Code §815 ILCS 530 (5): (1) An individual’s first name or first initial and last name in combination with any one or more of the following data elements, when either the name or the data elements are not encrypted or redacted or are encrypted or redacted but the keys to unencrypt or unredact or otherwise read the name or data elements have been acquired without authorization through the breach of security: (A) Social Security number, (B) Driver’s license number or state identification card number,  (C) Account number or credit or debit card number, or an account number or credit card number in combination with any required security code, access code, or password that would permit access to an individual’s financial account, (D) Medical information, (E) Health insurance information, (F) Unique biometric data generated from.  (2) User name or email address, in combination with a password or security question and answer that would permit access to an online account, when either the user name or email address or password or security question and answer are not encrypted or redacted or are encrypted or redacted but the keys to unencrypt or unredact or otherwise read the data elements have been obtained through the breach of security.

Pursuant to the Illinois Data Transparency and Privacy Act (SB2330), personal information does not include the following:

  • Publicly available information from government records.
  • Deidentified or aggregated consumer information.
  • Information excluded from the Illinois’s scope such as:
    • Health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data.
    • Personal information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FRCA), the Gramm-Leach-Bliley Act (GLBA) or Illinois Statutes Chapter 205, Financial Regulation §.1.Customer financial records; confidentiality, and the Driver’s Privacy Protection Act of 1994.

Purposes of Use of Personal Information

We may use or disclose the personal information we collect for one or more of the following purposes:

  • Our primary business is to provide claims management and related services nationally – including third-party claims administrator (or “TPA”) services, loss adjusting and associated risk consulting, and other services. Generally, we provide these services to entities that provide insurance coverage, issue or underwrite the policies, or are otherwise responsible for payment of the claims that we handle. We refer to these entities as “insurers” which broadly includes insurance companies, brokers, agents, underwriters, self-insured entities, and others entities that issue or underwrite policies, provide coverage for, or otherwise make decisions regarding the claims we handle.
  • As a part of our claims management services, we process claims and handle administrative functions for insurers, such as receiving notices of claims, administering forms and documentation requests and providing customer support-related services to . We also help insurers assess and establish their liability for particular claims and make recommendations related to the settlement of claims, including payments, repairs and replacements. We process personal information during the course of providing our claims management activities to insurers.
  • Our processing of personal information related to our claims processing is subject to the instructions of our respective clients – not this Online Privacy Policy. While our role depends upon the relevant circumstances, the Company is generally a data processor or service provider regarding the personal information that we process in the course of providing our claims handling services to insurers; we only process such personal information on behalf of and under the instruction of our clients or where otherwise required by law. In the event we are required to provide further notice of our processing of claims-related data for insurers, our activities will be subject to a privacy notice that is separate from this one.
  • Create, maintain, customize, and secure your account with us.
  • To help maintain the safety, security, and integrity of the website, products and services, databases and other technology assets, and business.
  • To respond to law enforcement requests and as required by applicable law, court order, or governmental regulations.
  • As described to you when collecting your personal information or as otherwise set forth in the CCPA and SB2330.
